Questions & Answers

Frequently Asked Questions

What types of employment agreements does Bakti Law review or draft?
We work with the full range of employment agreements used in the Malaysian workplace — standard fixed-term and indefinite contracts, managerial and executive agreements, probationary arrangements, and contracts for domestic workers covered under the Employment Act. We also assist with non-compete, confidentiality, and restraint-of-trade clauses, and help multinational subsidiaries adapt group templates to Malaysian statutory requirements.
How long does a contract review or drafting engagement take?
Standard turnaround for contract review and drafting is 7 to 10 working days. This includes two full rounds of review with tracked changes and advisory commentary. If you have a more pressing timeline, please mention this when you get in touch and we will let you know whether an earlier arrangement can be accommodated.
Can Bakti Law assist with Industrial Court proceedings?
Yes. Our labour dispute service covers matters referred to both the Industrial Court and the Department of Labour. This includes unfair dismissal claims, constructive dismissal cases, retrenchment benefit calculations, and collective agreement interpretation. We begin with an assessment of the merits of your matter before advising on the most appropriate path forward.
Do you work with both employers and employees?
We do. Bakti Law acts for both employers — ranging from SMEs to larger corporations — and for individual employees seeking advice on their rights and options. Where we have an existing relationship with a party on the other side of your matter, we will let you know at the outset so you can make an informed decision about proceeding.
How is payment structured for your services?
The published fees for contract review (RM 700) and workplace policy development (RM 1,600) are fixed. For dispute advisory and representation (from RM 2,900), fees depend on the complexity and duration of the matter. A payment schedule and scope of engagement are agreed in writing before work begins. All fees are subject to applicable taxes.
What documents should I prepare for an initial consultation?
For contract matters: share the existing draft or template you would like reviewed, along with any specific concerns or requirements. For policy work: a brief overview of your company size and current HR documentation is helpful. For disputes: bring the offer letter or employment contract, any relevant correspondence, and a short factual summary of the situation. You need not have everything prepared before reaching out — we can advise on what is needed once we understand your matter.
Does Bakti Law handle cases outside of Penang?
Our office is based in George Town, Penang, and we regularly assist clients across Peninsular Malaysia. Employment contract review, policy development, and advisory work can largely be handled remotely. For matters requiring physical attendance — such as conciliation sessions or court hearings — we will advise on logistics and any associated travel considerations at the relevant stage.
