- "Engagement Letter" — the formal document setting out the scope and terms of a specific legal services engagement.

2. Acceptance of Terms
Access to and use of this Website constitutes acceptance of these Terms. If you do not agree with any part of these Terms, you should not use the Website.
Use of the Website or submission of an inquiry through the contact form does not create a solicitor-client relationship. Such a relationship is established only upon mutual execution of an Engagement Letter and receipt of any agreed initial payment.
You must be at least 18 years of age and legally capable of entering into binding agreements to engage Bakti Law's services.
3. Nature of Website Content
The content published on this Website is for general informational purposes only. Nothing on this Website constitutes legal advice or creates any professional obligation on the part of Bakti Law. Employment and labour law matters are fact-specific, and general information should not be acted upon without obtaining advice tailored to your particular circumstances.
Bakti Law makes reasonable efforts to keep content current and accurate but does not warrant that information on the Website reflects the most recent state of Malaysian law at any given time.
4. Service Description
Bakti Law provides the following legal advisory services in Malaysia:
- Employment Contract Review & Drafting — reviewing or preparing employment agreements compliant with the Employment Act 1955 and Industrial Relations Act 1967, including two review rounds and advisory notes. RM 700 per engagement; turnaround within 7–10 working days.
- Workplace Policy Development — consultative development or overhaul of HR policies including disciplinary, grievance, and leave frameworks, aligned with Malaysian labour legislation. RM 1,600 per engagement; delivered within four to five weeks.
- Labour Dispute Advisory & Representation — advisory and representation services for Industrial Court or Department of Labour proceedings, including merit assessment, submission preparation, and hearing representation. RM 2,900 per engagement; duration subject to court scheduling.
Exact scope, deliverables, and fees for each engagement are confirmed in a written Engagement Letter prior to commencement.
5. Fees and Payment
Fees are denominated in Malaysian Ringgit (RM) and are as stated on this Website or as agreed in the Engagement Letter. Quoted fees apply to standard scope engagements as described. Matters requiring additional work beyond agreed scope will be discussed with the client before additional fees are incurred.
Payment terms, including the timing and method of payment, are specified in the Engagement Letter. Bakti Law accepts bank transfer as the standard payment method. Receipts will be issued upon payment.
Fees are not refundable once work has commenced, except as set out in the Engagement Letter or where Bakti Law has not delivered the agreed services.
6. User Responsibilities
When using this Website or engaging Bakti Law's services, you agree to:
- Provide accurate, complete, and current information when making an inquiry or instructing us
- Inform Bakti Law promptly if any information you have provided changes
- Use the Website only for lawful purposes
- Not attempt to circumvent the security or functionality of the Website
- Not submit content that is false, defamatory, offensive, or infringing of third-party rights

Employment and labour law matters are subject to evolving legislation, tribunal decisions, and fact-specific analysis. Results in any matter depend on its particular circumstances and cannot be predicted in advance.
11. Limitation of Liability
To the extent permitted by Malaysian law, Bakti Law's liability in connection with any claim arising from use of this Website or our services is limited to the fees actually paid by you for the specific engagement to which the claim relates.
Bakti Law is not liable for indirect, consequential, or special losses arising from use of the Website or reliance on its content, including loss of business, loss of income, or reputational harm.
Nothing in these Terms excludes liability for fraud, wilful misconduct, or any other liability that cannot be excluded under Malaysian law.
12. Termination of Engagement
Either party may terminate a legal services engagement by giving written notice, subject to the terms set out in the Engagement Letter. Upon termination:
- Fees for work completed up to the date of termination remain payable
- Bakti Law will provide a reasonable handover of documents and matter status
- Any confidentiality obligations continue to apply
Bakti Law may decline to act or may cease acting in a matter where required by professional conduct rules or applicable law.
13. Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute arising from use of the Website or an engagement with Bakti Law shall first be addressed through direct written communication to [email protected]. If the dispute is not resolved within 30 days of written notification, it may be referred to the courts of Malaysia, with the parties agreeing to the non-exclusive jurisdiction of the courts in Penang.
14. General Provisions
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
Entire Agreement
For legal services engagements, these Terms are supplemented by the Engagement Letter, which together constitute the entire agreement between the parties for the services described therein.
No Waiver
Failure by Bakti Law to enforce any provision of these Terms on any occasion does not constitute a waiver of its right to enforce that provision on any other occasion.
Assignment
You may not assign any rights or obligations under these Terms without Bakti Law's prior written consent.
15. Changes to These Terms
Bakti Law may update these Terms from time to time. Changes will be published on this page with a revised "Last Updated" date. Continued use of the Website following the publication of updated Terms constitutes acceptance of those changes.
